Preamble

These terms constitute the entire agreement between us with respect to your use of the Site. You agree that no partnership, employment or agency relationship exists between you and us as a result of your use of the Site. If any provision of these terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in this paragraph. The following provisions of these terms remain in full force and effect.
The Site is made available for use by individuals seeking employment openings (“placement seekers”), by individuals and/or organizations seeking to make available information regarding employment openings, on their behalf or other’s behalf (“placement provider”). If you are accessing or using the Site in your capacity as a placement provider you are agreeing to this Agreement on behalf of yourself and such placement provider as applicable, and you represent and warrant that you have the authority to bind such placement provider, as applicable, to this Agreement.
We may change this Agreement by notifying you through adding the legend “Last Updated” and the date on this page. Any such changes will not apply to any claim brought prior to the date on which we posted the revised Agreement incorporating such changes, or otherwise notified you of such changes. Your access to or use of the Site following any changes to this Agreement will constitute your acceptance of such changes.

Job Listings

RIZQED makes available through the site certain job listings and other job-related contents, including links to third-party websites. Job listings are created and provided by third parties over whom RIZQED exercises no control; you acknowledge and understand that we have no control over job listings. RIZQED does not have any obligation to screen any job listing, or to include any job listing in its search results or other listings, and may exclude or remove any job listing from the Site for any or no reason. We cannot confirm the accuracy or completeness or any job listing or other information submitted by any placement provider or other user, including the identity of such placement provider or other user. RIZQED assumes no responsibility, and disclaims all liability, for the content, accuracy, completeness, legality, reliability, availability of any job listing, and disclaims liability for any site, job solicitation, screener question, answer to screener question, CVs, information you post, send or receive through the Site. If you see any inaccuracy in any such material, it is your responsibility to correct such information. RIZQED does not promise to correct any inaccuracy.
For avoidance of doubt, RIZQED does not warrant or guarantee that a placement provider that lists a position on this site operates completely or partially as a Sharia compliant company. RIZQED does not warrant or guarantee that work associated with the position listed on the site will be completely or partially Sharia compliant. The placement seeker is responsible for determining the Sharia compliance of the work and the placement provider. RIZQED disclaims responsibility or knowledge for the objectives of company or the scope of the work offered.
If you are an placement provider, when you post a job listing on the Site, you are responsible for the contents of any job listings that you post. RIZQED may reject or remove any job listing at its discretion. RIZQED does not guarantee the accuracy of the placement seekers’ CV and details. You agree that RIZQED assumes no responsibility for the communications between you and the placement seeker. You shall indemnify, defend and hold harmless RIZQED from any third-party claim or liability (including without limitation reasonable legal fees) for any job listing or communications between you and the placement seeker.
If you are a placement seeker, any resume or application information that you submit through the Site is subject to this Agreement. Without limiting the foregoing, however, please note that by creating a CV through the Site, you are requesting and authorizing RIZQED to make available your resume to any placement provider registered on the site that may have an interest in your resume. By creating or uploading a CV, RIZQED may contact you to share job listings with you that match the contents of your CV. RIZQED does not guarantee that any placement provider will receive, access, read or respond to any such CV or application material, or that there will be no mistakes in the transmission of the data. We cannot vouch for the validity of such contact information provided to us by the placement provider. RIZQED does not guarantee the validity of a job offer and cautions placement seekers to verify the validity of a job offer before taking an adverse action regarding their current employment situation.

Reliance on Information

If you provide any information that is inaccurate or not current, or We have reasonable grounds to suspect that such information is inaccurate or not current, RIZQED have the right to suspend or terminate your account and refuse any and all current or future use of the Site. In consideration of your use of the Site, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of any applicable jurisdiction.
RIZQED disclaims any liability and responsibility for any potential misrepresentations in information posted by the either the placement provider or agent of the placement provider, or any placement seeker or his/her representative. All information uploaded and/or advertised on the Site job site will be considered to have originated with the placement provider or placement seeker.
Commentary and other materials posted on the Site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to the Site, or by anyone who may be informed of any of its contents.
Any information uploaded and/or advertised on the site will be deemed to have been the property of the one who has uploaded the information. RIZQED disclaims any infringement of intellectual property and privacy rights due to information uploaded and/or advertised by placement providers or third parties.

Uploading Material

Whenever you make use of a feature that allows you to upload material to the Site, or to make contact with other users of the Site, you must comply with the content standards as expected by other job listing sites such as Monster.com, Indeed.com, Michaelpage.com, and others. You warrant that any contribution complies with those standards, and you indemnify us for any breach of that warranty. Any material you upload to the Site will be considered non-confidential and non-proprietary, and We have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the Site. We have the right to remove any material or posting you make on the Site if, in our opinion, such material does not comply with content standards.
Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Prohibited Uses

You may use the Site only for lawful purposes. You may not use the Site in any way that breaches any applicable local, national or international law or regulation, or that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect, You may not use the Site to send, knowingly receive, upload, download, use or re-use any material which does not comply with content standards considered reasonable and relevant to the purpose of this site. You may not transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam).
You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence. We will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any material posted on it, or on any website linked to it.
You also agree not to reproduce, duplicate, copy or re-sell any part of the Site in contravention of the provisions of our terms of website use. You also agree not to access without authority, interfere with, damage or disrupt: any part of the Site, any equipment or network on which the Site is stored, any software used in the provision of the Site, or any equipment or network or software owned or used by any third party.

Intellectual Property

RIZQED agrees and acknowledges that the intellectual property rights in any posting made by the placement provider or placement seeker (both to be considered as the “Customer”) shall at all times remain the property of the one who posts. The customer grants RIZQED an irrevocable, worldwide, royalty-free, perpetual and non-exclusive licence to use, copy, reproduce, publish, display and distribute such postings (in whole or in part) along with a non-exclusive, royalty-free, non-transferable licence to use, display, copy and publish any customer trademarks, logos or other intellectual property provided to RIZQED for the purposes of performing the Services. RIZQED warrants to the customer that any customer intellectual property used by RIZQED shall be used solely for the purposes of RIZQED performing its obligations under this Agreement and for providing the services to the customer.

Confidentiality and Data Protection

All information given by either party (“Disclosing Party”) to the other (“Recipient”) or otherwise obtained by the Recipient relating to the Disclosing Party’s business or operations (except for information which is in or enters the public domain) shall be treated by the Recipient as confidential and not used other than for the benefit of the Disclosing Party, nor disclosed to third parties without the Disclosing Party’s prior written consent, except in each case to the extent required by law or for the purposes of performing its obligations or enforcing its rights under this Agreement. The Disclosing Party or the Recipient could either be a placement seeker or placement provider.

Indemnities and Limitation of Liability

The material displayed on the Site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, RIZQED expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity. RIZQED disclaims any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the Site or in connection with the use of the Site such loss of income or revenue; loss of business; loss of job; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
The Customer shall indemnify RIZQED and its affiliates from and against any claims, action, or demands (including reasonable legal fees) arising from the infringement or alleged infringement of any third party intellectual property rights in any posting and for the customer’s gross negligence or willful misconduct arising out of or relating to the customer or any group company’s use of the Services.

Suspension and Termination

RIZQED will determine, in our discretion, whether there has been a breach of content standards through your use of the Site. When a breach of this policy has occurred, RIZQED may take such action that may result in immediate, temporary or permanent withdrawal of your right to use the Site.

Jurisdiction and Applicable Law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Site although, we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
